Failure to Maintain Lane Lawyer

by James L. Paisley

Atlanta Ticket LawyerHave I Violated Georgia’s Failure to Maintain Law?
This statute reads as follows:
Failure to Maintain Lane (O.C.G.A. § 40-6-48). A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.

Usually this offense is the basis to stop someone for DUI. Even if someone is innocently staying within their lane, officers often find that the slightest movement from one side of the lane to the other is their basis to pull you over and hassle you.

If not the basis of a DUI stop, this charge would probably involve an accident case where another vehicle accuses you of coming into their lane and hitting their vehicle. Or maybe you were involved in a single car accident that is not your fault at all, but the officer just decides someone has to get a ticket so he writes you up for this even though you did nothing wrong.
