Atlanta Municipal Court Failure to Appear
by James L. Paisley
Atlanta Municipal Court has some of the more stringent policies on failing to appear for your court date (FTA’S). If you miss a court date, most courts will allow you to just pay the citation and a late penalty to resolve the case quickly without coming to court. That is not the case with Atlanta Municipal Court. Whether it’s a seatbelt ticket, a stop sign ticket, or something like a tag light citation, Atlanta will make you personally appear to get the warrant for your arrest set aside and the FTA cleared. If you are close by and local, it won’t be too much trouble to resolve it on your own. Your case still could qualify for diversion for minor charges, and they most likely will not take you into custody for the warrant.
Here is what you need to know about Atlanta Municipal Court’s FTA Court:
FTA Court in Atlanta is much more efficient now under the direction of the Honorable Judge Chris Ward. Court moves very quickly, and if you get there early – before 7:30 A.M., you should be done before 9:30AM. Many people that call my office are concerned there will be insurmountable FTA/warrant fees, but for the time being (early 2018) that is not the case – the Judge has been setting aside just about all warrant fees recently. This has saved our clients a lot of money.
If you resolve your case within 28 days of your missed court date, your license will not get suspended. If it is after that 28 day period, you will need to check with the GA Department of Driver Services after your Atlanta case is resolved and ascertain whether any reinstatement fees need to be paid to DDS.
Nobody really wants to go to court in Downtown Atlanta at 7:00 A.M to handle an old ticket they don’t remember getting. If you hire a lawyer, you most likely will not have to appear. This is great for clients that live out of state or have demanding work schedules that make coming to downtown very difficult, expensive, and burdensome.
